The Alabama Department of Public Health has denied an application for license submitted by Ochata Management, L.L.C., of Birmingham to operate an abortion or reproductive center. The department had proposed to revoke the license of New Woman All Women Health Care in Birmingham due to multiple and serious violations of State Board of Health rules. A consent agreement allowed the opportunity for another entity or individual being “independent from and not affiliated with New Woman or its officers and directors” to seek a license to operate the center. A business lease agreement that was submitted in support of the application includes a provision in regard to monthly rent whereby the landlord identified as the outgoing operator and tenant identified as the proposed new operator agreed to meet on a monthly basis to mutually determine the center’s monthly income and monthly overhead. The provision further provides that the excess of monthly income over monthly overhead is to be considered as rent due and payable to the landlord. The license denial states, “It is clear that this arrangement would allow the former operator to remain involved in the center’s financial affairs and to be entitled to all the profits from the continued operation of the center; it does not allow for the proposed new operator to independently operate the center.” The decision may be administratively appealed by Ochata Management. |
